Making a purchase on this website or paying an invoice is a binding contract and you are agreeing to comply with the information given on the product page and the following terms and conditions.
Cancellations + Date Changes:
Cancellations must be made within 48 hours of placing the order for a 75% refund. Beyond 48 hours no refunds or credits will be given. Date changes must be made at least 14 days prior to the initially scheduled pick-up or delivery date. Date changes made 13-7 days prior to the initially scheduled pickup or delivery date will be charged a 25% rescheduling fee if both parties mutually agree upon the new date. Date changes made 6 days prior or less to the initially scheduled pick-up or delivery date will be charged a 50% rescheduling fee if both parties mutually agree upon the new date. If a date change is requested but both parties are unable to mutually agree upon a new date your order will therefore be cancelled, but no refunds will be given unless these changes were made within 48 hours of placing the order.
Late Pick-up + Time Change Fees
There is a 14 minute grace period for pick ups. If you arrive 15 minutes late to pick up your order a $20 fee will be charged; every additional 5 minutes (up to 45 additional minutes) you are late will be an additional $10 added to your late fee. If you are over 60 minutes late you will be charged the appropriate late fee and your order will be placed on the porch and unattended. If you are requesting a new pick up time, but the date remains the same, these requests must be made a minimum of 48 hours prior to the initially scheduled pick up or delivery time. If time changes are requested 48 hours prior to the initially agreed upon pick up or delivery time, and both parties mutually agree to the new pickup or delivery time only a $5 fee will be charged. If time changes are requested less than 48 hours prior to the initially agreed upon pick up or delivery time and both parties mutually agree upon the newly requested time a $20 fee will be charged. If the newly requested time is not mutually agreed upon the original time remains and late fees will be charged accordingly.
Changes made to your order such as quantity or flavors may be accepted but is up to our discretion and fees may be charged.
Porch Pickup Liabilities
If you have agreed to a porch pick up Martinez Made is waived of all liabilities to your order including, but not limited to, damages caused by weather or items being stolen. Your order will be placed on the porch no sooner than 5 minutes prior to your scheduled pickup time. You are responsible for picking up your order in a timely manner. If you have not come to pick up your order within 1 hour of the scheduled pick up time you are waiving your right to claim your order and it will be disposed of or given away and no refunds will be given.
Martinez Made is a Cottage Bakery and operates out of a home kitchen that is not inspected by a health organization. This kitchen comes into contact with meat, wheat, soy, dairy, and nuts.
The day you order or before you may submit inspiration photos based on anything including: party decorations, invitations, other baked goods, etc. Design and colors will be matched as best as possible according to the images provided. Note that all things are done and made by hand so slight variations may occur. Design changes may not be accepted. If design changes are accepted fees may be charged. Orders will be prepared according to the order placed on the website or the paid invoice.
The delivery time on your order form is an approximation, actual delivery time may vary.
Unavoidable Delivery Occurrence
In the case of an unavoidable delivery occurrence, such as a car accident, poor road conditions, inclement weather, etc… Martinez Made is only responsible for refunding 50% of the price of the cake or cookies placed in your order.
It is our recommendation to always have your order delivered. If you chose to have your order picked up, Martinez Made is not responsible for damage to any order once it has left our hands. Since our cakes and cookies are made with ingredients that can melt in the heat or smudge in humidity, cakes and cookies should never be left in direct sunlight or in a hot vehicle. Cakes and cookies should be transported in a cool and flat area with plenty of space (the floorboard of a car or backseat is not suggested). Any repairs or additional cakes or cookies will be subject to additional fees.
Martinez Made promises you the best product and service we can provide. It’s always our goal to exceed your expectations and truly believe a referral is the best compliment. It is your responsibility to inspect the cake and/or cookies upon delivery and contact us with any concerns immediately.
